The U.S. Department of Housing and Urban Development has issued a formal charge against the Washington State Housing Finance Commission, alleging that a state-run homebuying assistance program unlawfully discriminates based on race. The action targets the commission’s “Homeownership Assistance Program for Black, Indigenous, and People of Color Communities.”
In its charge, HUD contends that by limiting eligibility to specific racial and ethnic groups, the program violates the federal Fair Housing Act. The agency argues the act prohibits discrimination on the basis of race, including what it terms “discriminatory benefits.” This move aligns with a broader political critique of Diversity, Equity, and Inclusion (DEI) initiatives, which the administration has frequently denounced.
Washington state officials have defended the program as a necessary tool to address a persistent and significant homeownership gap. Historical housing policies like redlining have created generational wealth disparities, and the program is designed to help level the playing field for families from systematically marginalized communities. The state now faces a potential hearing before a HUD administrative law judge, which could result in an order to modify or cease the program unless a conciliation agreement is reached. The challenge highlights a deepening national debate over how to remedy historical inequities within the bounds of existing civil rights law.
