Homie Takes Real Estate Antitrust Fight to Appeals Court

Homie Technologies is pushing back against a dismissed antitrust lawsuit, now asking a federal appeals court to breathe new life into its claims against the National Association of Realtors and several large real estate brokerages. The Utah-based company argues that the lower court made a mistake when it threw out the case, which accuses the defendants of conspiring to keep disruptive business models out of the housing market.

At the heart of the dispute is Homie's flat-fee listing service, a model that challenges the traditional commission structure. Homie claims that the NAR and its allies used their control over listing databases and showing rules to squeeze out discount brokers. The company says these practices hurt competition and kept home prices artificially high for sellers.

The appeal comes after a district judge ruled that Homie did not provide enough evidence to show a conspiracy. Homie's legal team disagrees, saying the judge applied too strict a standard at the pleading stage. They want the Tenth Circuit Court of Appeals to review the case and allow discovery to proceed so they can gather more proof.

Industry watchers are paying close attention because the outcome could affect how real estate commissions are handled nationwide. The NAR has not commented on the appeal yet, but the organization has defended its rules in the past, saying they benefit consumers and promote transparency. A ruling in Homie's favor could open the door for more legal challenges to the traditional commission system.
