Real estate lawyer Gary Singer addressed this pressing concern, clarifying that HOAs do hold the power to implement rules and regulations that can affect residents' behavior, including smoking.

As such, they can create policies that restrict smoking in common areas, and in some cases, they may extend these regulations to private residences. This is particularly relevant in communities where secondhand smoke could impact the health and comfort of other residents.
Singer emphasized that any restrictions imposed by an HOA must be clearly outlined in the community’s governing documents. Homeowners are encouraged to review these documents to understand their rights and obligations. If residents feel that the rules are unreasonable, they may have avenues to challenge them, but it often requires a collective effort from the community.
